Proposed SHARP revisions and power Press Revisions

Sharp Revision will permit un-announced OSHA site inspections for SHARP participants within the following changes:
> Head of OSHA is given the ability to define SHARP sites for inspection.
> Permission of enforcement inspections under "certain circumstances".
> Limitation of the exemption period for SHARP sites.

The Fall 2009 Agenda includes a proposal to update and revise the Mechanical Power Press standard to increase the classes of machines covered within the standard and to update guarding to reflect available technology.

OSHA Regulations

Summary: The Senate has introduced an OSHA-sponsored bill to increase fines and penalties for regulatory violations. Note Section 310 and 311

310 Summary:

Any employer who willfully or repeatedly violates ... any standard, rule, or
order ... may be assessed a civil penalty of not more than $70,000 $120,000 for each violation, but not less than $5,000 $8,000 for each willful violation.

Any employer who has received a citation for a serious violation...

shall be assessed a civil penalty of up to $7,000 $12,000 for each such violation.

311 Summary:

Raises potential sentence for any employer or responsible corporate officer to ten years in cases of violations resulting in death.
